LITIGATION

Civil litigation (as opposed to criminal law) is the branch of law dealing with disputes between individuals and / or organisations, in which compensation, usually in the form of money, may be awarded to the victim.

It can often involve requiring another party to do something or not to do something. Examples include breach of contract, actions for injunctions or cases in which the court is asked to declare the rights of the parties.

Here at Cook & Talbot, our litigation department can provide you with a range of services to cover all your litigation needs wether you are an individual acting in person, or an organisation such as a company or partnership. We have experience in all aspects of contentious law including negligence and contract, debt and enforcements of judgments, partnership disputes, disputed wills and inheritance claims, property matters including disputes between neighbours, landlord and tenant, consumer credit, MIB, CICA, CSA claims and injunctions.

Your case will be handled by a Partner and/or a qualified Solicitor at all times. We understand that there is great concern over the costs of pursuing or defending a claim. We will advise you fully on the funding options that may be available to you which may include “no win no fee”, before the event insurance, a private retainer with flexible payment arrangements or funding by a third party such as the legal services commission.

We are committed to resolving disputes proportionately and efficiently and have experience in negotiation and mediation as alternative forms of dispute resolution.
