Lasting Powers of Attorney

As of 1st October 2007 Enduring Powers of Attorney have been replaced with Lasting Powers of Attorney (LPAs). There are two different types of LPA: Health and Welfare and Property and Financial Affairs.

The forms themselves are very different from the previous Enduring Powers of Attorney: they are much longer and give the donor more choice, and are also more stringent and are designed to offer more protection to the donor. Another change is that it is now mandatory for all LPAs to be registered with the Office of the Public Guardian (the new name for the Public Guardianship Office) before they can be used for which there is a fee to the Office of the Public Guardian.

Our fees for preparing a Lasting Power of Attorney start from £350 plus VAT for one LPA (either Personal Welfare or Property and Affairs), and £500 plus VAT for both. Please contact Rebecca Ind (Southport office) or Sarah Rostamlou (Ainsdale office) for further details.

Deputyship Orders – Court of Protection

We attend to the completion of all necessary documents to enable a Deputy to be appointed under the Court of Protection procedure where someone is unable to deal with their affairs on their own. A Deputy can be appointed to deal with property and affairs and/or personal welfare. The fees payable are those directed by the Court of Protection.
